Refund Policy

1. STRICT NO-REFUND POLICY

All payments made to the Institute are strictly non-refundable and non-transferable, except in the limited circumstances expressly defined in this Policy.

This includes, but is not limited to:

• Voluntary withdrawal from the program
• Change of personal plans, career decisions, or preferences
• Failure to meet academic, training, or performance standards
• Delay or failure in documentation, DGCA processes, or visa procedures
• Financial constraints or inability to continue
• Dissatisfaction with training, faculty, facilities, or services
• Absenteeism, misconduct, or termination by the Institute
• Any unforeseen personal, medical, or external circumstances

No claims for refund, adjustment, transfer, or compensation shall be entertained outside the scope of this Policy.

2. TOKEN OF CONFIRMATION (TOC) – SPECIFIC REFUND CONDITIONS

The Token of Confirmation ("TOC") is a non-transferable amount paid to reserve a seat in a specific batch prior to commencement of training.

Refund Eligibility (Strictly Limited)

The TOC shall be eligible for refund only if ALL of the following conditions are satisfied:

• The Cadet is declared Permanently Medically Unfit for pilot training
• Such status is officially confirmed by the Directorate General of Civil Aviation (DGCA)
• The final medical status is reflected in the Cadet's record on the DGCA eGCA portal

Clarifications

• Any preliminary medical report, including CA35 or doctor-issued unfitness, shall not be considered valid for refund eligibility
• Refund shall be processed only after submission and verification of DGCA eGCA medical status confirming permanent unfitness
• The Institute reserves the right to independently verify such status through official records

Refund Terms

• The TOC amount shall be refunded after deduction of applicable taxes (including GST)
• No other payments, charges, or fees shall be refundable under this clause

3. DEPOSIT REFUND (POST-ENROLMENT STAGE)

Where applicable, a refundable deposit (up to ₹80,000) may be paid by the Cadet upon enrolment.

Refund Eligibility (Strictly Limited)

Refund of the deposit shall be considered only if:

• The Cadet is declared Permanently Medically Unfit by DGCA, and
• Such status is verified through official DGCA records

Refund Conditions

• Refund shall be processed only after 365 days from the date of commencement of flight training
• The Cadet must have complied with all program terms
• The Cadet must not have committed any breach of agreement
• The Cadet must have completed all required formalities

Failure to meet any condition shall result in forfeiture of the deposit.

4. NON-REFUNDABLE COMPONENTS

Without limitation, the following shall remain strictly non-refundable:

• Registration / admission fees
• Administrative charges
• Ground training fees (partial or full)
• Simulator training fees
• Study materials (physical or digital)
• Taxes (including GST)
• Any discounted, promotional, or special program fees
• Any amount paid towards third-party services

5. THIRD-PARTY SERVICES

The Institute may facilitate services through third-party providers, including but not limited to:

• Flight training organisations
• Visa consultants
• Documentation agencies

All payments made to such third parties:

• Are governed by their respective policies
• Shall not be refundable by the Institute under any circumstances

The Institute shall not be liable for any dispute, delay, or refund arising from third-party services.

6. NO TRANSFER / ADJUSTMENT / CARRY FORWARD

• Payments made are non-transferable to any other individual
• No batch transfer, credit note, or adjustment shall be permitted
• No amount shall be carried forward under any circumstances

7. CANCELLATION BY INSTITUTE

In the unlikely event that the Institute cancels or discontinues a program prior to its commencement, the Institute may, at its sole discretion:

• Offer an alternative batch or program, or
• Provide a partial or full refund

No additional compensation, damages, or claims shall be entertained.

8. CHARGEBACKS, DISPUTES & RECOVERY

Any attempt to initiate:

• Chargebacks
• Payment reversals
• Banking disputes

without valid legal grounds shall constitute a material breach of this Policy and associated agreements.

The Institute reserves the right to:

• Initiate legal proceedings
• Recover outstanding dues, damages, interest, and legal costs

9. ACKNOWLEDGEMENT & BINDING CONSENT

By making any payment to the Institute, the Cadet and Sponsor:

• Confirm that they have read, understood, and accepted this Refund Policy
• Acknowledge that all payments are strictly non-refundable except as expressly stated herein
• Agree to be legally bound by this Policy

10. GOVERNING LAW & JURISDICTION

This Policy shall be governed by the laws of India. All disputes shall be subject to the exclusive jurisdiction of courts where Rian Air LLP is registered in India.
